1) STUDENT PARTICIPATION AGREEMENT, WAIVER & RELEASE OF LIABILITY
This Agreement applies to all classes, workshops, open studio sessions, and related activities offered by Tock Custom Sewing & Arts Center including but not limited to: sewing, quilting, embroidery, weaving, fiber arts, felting, knitting, crocheting, painting, drawing, sketching, watercolor, mixed media, collage, bookbinding, printmaking, and other arts and craft instruction. Studio equipment covered by this Agreement includes, without limitation: Domestic and industrial sewing machines, sergers and overlock machines, embroidery machines (commercial and domestic), rotary cutters, self-healing mats, and cutting guides, fabric scissors and shears (all sizes), electric and steam irons and garment steamers, hand and machine needles (sewing, tapestry, embroidery, quilting), hot glue guns and adhesive dispensers, fabric dyes, inks, paints, adhesives, and related chemicals, cutting machines (Cricut, Silhouette, and similar devices, heat press machines and transfer equipment, art easels, canvases, and painting tools, all other studio tools and equipment as posted on-site.
ASSUMPTION OF RISK
I, the undersigned student, acknowledge and agree that participation in sewing, fiber arts, visual arts, and related craft activities at Tock Custom Sewing & Arts Center involves inherent risks of injury or harm, including but not limited to: cuts, lacerations, and puncture wounds from scissors, rotary cutters, needles, pins, and sharp studio tools; burns and scalds from irons, steamers, hot glue guns, heat press machines, and other heated equipment; eye injuries from needle breakage, flying debris, thread, or chemical splash; needle punctures from hand-sewing and machine sewing; chemical exposure from fabric dyes, textile adhesives, paints, fixatives, solvents, and cleaning agents; allergic reactions to dyes, adhesives, latex, synthetic or natural fibers, or other studio materials; slip, trip, and fall hazards within the studio environment; repetitive motion injuries from extended sewing, cutting, or crafting activities; and other risks inherent to creative arts and crafts participation. I voluntarily assume all such risks. I had the opportunity to ask questions about these risks and do so freely and with full knowledge of said risks.
RELEASE OF LIABILITY
In consideration of being permitted to participate in activities and use facilities and equipment at Tock Custom Sewing & Arts Center, I, the undersigned student, hereby voluntarily and knowingly release, waive, discharge, and covenant to not sue Tock Custom Sewing & Arts Center, its owners, directors, officers, instructors, employees, volunteers, and agents (collectively “Released Parties”) from any and all claims, demands, losses, actions, or liability from personal injury, property damage, or death arising from my participation in studio activities, including claims arising from the released parties’ own negligence. The word ‘negligence’ as used in this release is intended in its full legal sense and includes the failure to exercise reasonable care. This release do not apply to, and expressly excludes, any claims arising from the intentional misconduct or reckless conduct that constitutes willful, wanton, or reckless disregard for the safety of participants. I have carefully read the release, understand its contents, and agree to it voluntarily as my own free act. This is a legally binding agreement, if I am uncertain, I will seek legal advice before agreeing to it.
INDEMNIFCATION
I agree to indemnify and hold harmless Tock Custom Sewing & Arts Center and its owners, directors, officers, instructors, employees, volunteers, and agents from and against any and all claims, suits, demands, losses, damages, costs, and attorneys' fees arising out of or related to: (a) my participation in studio activities; (b) my use of studio equipment; (c) my violation of any studio rule or this Agreement; or (d) any claim brought by a third party related to my conduct at Tock Custom Sewing & Arts Center. This indemnification obligation does not apply to claims arising from Tock Custom Sewing & Arts Center's own intentional misconduct or reckless conduct.
HEALTH AND MEDICAL DISCLOSURE
Please disclose any health conditions, physical limitations, or allergies that may affect your safe participation in studio activities. This information is kept confidential and used solely to provide a safe environment. Disclosure is voluntary but strongly encouraged. 2) STUDIO EQUIPMENT USE AGREEMENT
This Agreement governs User's access to and use of all studio equipment and tools provided by Tock Custom Sewing & Arts Center, including but not limited to: Domestic sewing machines (all makes and models available in studio), industrial and commercial sewing machines, sergers and overlock machines, embroidery machines (domestic and commercial), cutting machines (Cricut, Silhouette, and similar electronic cutting devices), rotary cutters, self-healing mats, and cutting guides, mat cutters and straight-edge cutting tools, irons and garment steamers (all sizes and types), heat press machines and transfer equipment, dress forms and mannequins, art easels, canvas frames, and painting equipment, kilns (if applicable — ceramic/fiber arts), all other tools, equipment, and studio infrastructure as posted on-site.
USER RESPONSIBILITIES
By executing this Agreement, User agrees to the following responsibilities: 1) Inspect Before Use. User shall inspect each piece of equipment before use and shall not use equipment that appears damaged, malfunctioning, or unsafe. 2) Report Damage Immediately. User shall immediately notify [Tock Custom Sewing & Arts Center] staff of any equipment damage, malfunction, or safety hazard observed before, during, or after use. 3) Return to Proper State. User shall return all equipment to its proper operating condition at the end of each session, including threading machines back to neutral, powering off all equipment, and returning accessories to their designated locations. 4) Follow Posted Instructions. User shall follow all posted operating instructions and safety guidelines for each piece of equipment. 5) No Unauthorized Modifications or Repairs. User shall not attempt to repair, modify, or alter any studio equipment. All maintenance must be performed by authorized Tock Custom Sewing & Arts Center personnel only. 6) Clean Work Area. User shall leave their work area clean and free of fabric scraps, thread, pins, and other materials.
DAMAGE AND REPLACEMENT LIABILITY
User is financially responsible for any damage to studio equipment caused by user’s misuse, negligence, recklessness, or failure to follow posted instructions or this agreement. Liability for damage includes, without limitation: cost of repair, cost of replacement at current market value, and any costs associated with the equipment being out of service. Normal wear and tear is excluded. Tock Custom Sewing & Arts Center will assess damage in good faith and provide User with written notice of any claim. Payment is due within 30 days of written notice. Tock Custom Sewing & Arts Center reserves the right to revoke equipment access privileges pending resolution of any damage claim.
PROHIBITED USES
The following uses of studio equipment are expressly prohibited without prior written permission from [Tock Custom Sewing & Arts Center]: Use of studio equipment for commercial production, including production of goods for sale, commercial fulfillment orders, or client work; teaching or instructing others in the use of studio equipment, whether compensated or not, without written authorization from Tock Custom Sewing & Arts Center; use of studio equipment outside of scheduled open studio or rental hours; Allowing unauthorized third parties to use studio equipment; and use of equipment for any purpose contrary to posted studio rules or applicable law.
3) STUDIO POLICIES, CLASS RULES, STUDENT CODE OF CONDUCT & CANCELATION POLICY
Classes and workshops are subject to a minimum enrollment of 4 students. If minimum enrollment is not met, Tock Custom Sewing & Arts Center reserves the right to cancel the class. Students will receive a full refund to the original payment method within 3-5 business days of cancellation notice.
Some classes include a materials/supply fee in addition to the class tuition. Supply fees are disclosed at registration and non-refundable.
TARDINESS AND ATTENDANCE POLICY
Students are expected to arrive on time and attend all sessions of a multi-session class. Tock Custom Sewing & Arts Center] does not offer refunds or credits for sessions missed by the student due to personal scheduling conflicts. Students arriving after the class start time will be able to continue the class at the instructor’s discretion. Rescheduling or refunds are not guaranteed. Tock Custom Sewing & Arts Center does not offer individual make-up sessions for student absences.
SAFETY RULES & STUDIO ETIQUETTE
1. No open beverage containers in the classroom. All beverage containers must have a lid.
2. Report all injuries and equipment malfunctions immediately to the class instructor or studio staff. Do not attempt to self-treat injuries in the studio.
3. Do not operate equipment outside of your demonstrated skill level. Ask an instructor for guidance at any time.
4. Do not leave sewing machines, irons, or other powered equipment running unattended.
5. Each student is responsible for cleaning their workspace at the end of every class session. This includes removing fabric scraps, thread, pins, and personal materials from tables and cutting mats.
6. Treat shared studio materials, tools, and supplies with care. Return all shared items to their designated locations after use.
7. Cell phones must be silenced during instructional time. Photography and recording of the instructor's proprietary patterns, handouts, or techniques is prohibited.
8. It is not required but students with longer hair may want to tie their hair back when operating sewing machines, sergers, or any motorized equipment.
CODE OF CONDUCT
1. Respectful Environment. Tock Custom Sewing & Arts Center is committed to providing a welcoming, inclusive, and respectful creative environment for all students, instructors, and staff. All participants are expected to treat one another with dignity and respect, regardless of age, background, skill level, race, ethnicity, gender, sexual orientation, disability, or any other characteristic.
2. Zero Tolerance for Harassment. Tock Custom Sewing & Arts Center has a zero-tolerance policy for harassment, discrimination, bullying, or threatening behavior of any kind. This applies to in-person interactions and online communications related to studio activities.
3. Removal Policy. Tock Custom Sewing & Arts Center reserves the right to remove any student from class or the studio at any time for disruptive, unsafe, or inappropriate behavior. No refund will be issued to a student removed for conduct violations.
CLASSROOM GUESTS
Class charge is per station with one student per station. One non-participating guest (parent, child, friend, etc.) is allowed if they would like to share the experience but not participate in the project. If your guest would like to participate in the project and work on a machine, they need to complete their own registration for a spot.
INTELLECTUAL PROPERTY
All patterns, handouts, curriculum materials, and instructional content provided by Tock Custom Sewing & Arts Center or its instructors are protected by copyright and are provided to enrolled students for personal use only. Students may not: Reproduce, photocopy, scan, or distribute any class handout or pattern; post instructor patterns or curriculum materials online in any form; or use class materials for commercial purposes without written permission from the copyright holder.
PHOTOGRAPHY AND SOCIAL MEDIA
Students are welcome to photograph and share images of their own creative work produced at Tock Custom Sewing & Arts Center. Students may not photograph other students' work without that student's express verbal permission, and may not post photographs of other students' faces or personal information on social media without their written consent. When sharing images of studio work on social media, students are encouraged to tag Tock Custom Sewing & Arts Center.
LOST OR STOLEN ITEMS
Tock Custom Sewing & Arts Center is not responsible for any personal belongings lost, stolen, or damaged while on studio premises. Students are encouraged to label personal materials and tools.
GOVERNING LAW AND GENERAL PROVISIONS
This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Ozaukee County, Wisconsin. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement represents the entire understanding of the parties with respect to its subject matter.
POLICY UPDATES
Tock Custom Sewing & Arts Center reserves the right to update these policies at any time. Students will be notified of material changes by email or posted notice. Continued enrollment after notice of a policy change constitutes acceptance of the updated policies.
